從制度可行性的角度來說，俄羅斯的聯(lián)盟號(hào)飛船也是更優(yōu)的選項(xiàng)。哪怕在烏克蘭戰(zhàn)爭(zhēng)爆發(fā)兩周年、美西方與俄羅斯關(guān)系嚴(yán)重惡化的今天，美俄圍繞國(guó)際空間站的航天合作仍在延續(xù)。當(dāng)然，雙方的合作層次已經(jīng)遠(yuǎn)不如美國(guó)航天員租用俄羅斯飛船進(jìn)入太空的時(shí)期，而對(duì)于太空救援這種高風(fēng)險(xiǎn)活動(dòng)，波音和NASA必然會(huì)考慮更多的利害因素。

但是，美國(guó)早已明令禁止了所有與中國(guó)的官方航天合作，再加上《國(guó)際武器貿(mào)易出口條例》、《出口管理?xiàng)l例》、對(duì)外投資審查委員會(huì)等其他政策壁壘，連企業(yè)與中國(guó)的航天合作都寸步難行。波音向國(guó)際空間站運(yùn)送NASA航天員，并接受NASA的監(jiān)管，在這種情況下向中國(guó)求助，顯然違反了《沃爾夫修正案》的規(guī)定，首先NASA就不會(huì)同意。當(dāng)然，這也說不準(zhǔn)，畢竟NASA已經(jīng)開始探討如何在不違反《沃爾夫修正案》的前提下向中方索要嫦娥六號(hào)帶回的月壤。似乎當(dāng)中國(guó)主動(dòng)幫忙和提供好處的時(shí)候，《沃爾夫修正案》就可以“靈活變通”了。

但是，真正關(guān)鍵的問題還不是中國(guó)提供救援的可行性，而是中國(guó)究竟有沒有救援的義務(wù)，尤其是法定義務(wù)。

03. 若波音上門求援，中國(guó)有權(quán)置之不理？

隨著人類太空探索事業(yè)的發(fā)展，如何保障航天員的生命安全已成為一個(gè)不容回避的現(xiàn)實(shí)問題。對(duì)此，在廣大成員國(guó)的推動(dòng)下，以聯(lián)合國(guó)為核心的國(guó)際組織制定并通過了一系列關(guān)于規(guī)范太空活動(dòng)行為和防范太空活動(dòng)風(fēng)險(xiǎn)的制度規(guī)范，構(gòu)成了相關(guān)的國(guó)際空間法體系，其中具有代表性的是《外層空間條約》（Outer Space Treaty）和《營(yíng)救協(xié)定》（Rescue Agreement）。中國(guó)分別于1983年和1988年加入了這兩項(xiàng)條約。

作為國(guó)際空間法體系的第一部成文法，《外層空間條約》確立了對(duì)太空活動(dòng)的一系列指導(dǎo)原則，其中就對(duì)航天員的營(yíng)救行動(dòng)。第五條指出：

“發(fā)現(xiàn)航天員有意外事故、危難或在另一當(dāng)事國(guó)境內(nèi)或公海上緊急降落之情形，應(yīng)給予一切可能協(xié)助。在航天員作此種降落時(shí)，應(yīng)即將其安全而迅速送回航天器登記國(guó)（States Parties to the Treaty shall regard astronauts as envoys of mankind in outer space and shall render to them all possible assistance in the event of accident, distress, or emergency landing on the territory of another State Party or on the high seas. When astronauts make such a landing, they shall be safely and promptly returned to the State of registry of their space vehicle）?！?

《營(yíng)救協(xié)定》則對(duì)營(yíng)救行動(dòng)作了更加詳細(xì)的規(guī)定?；凇锻鈱涌臻g條約》第五條所指的情形，《營(yíng)救協(xié)定》第一條說明了締約國(guó)應(yīng)如何提供協(xié)助：

首先，通知發(fā)射當(dāng)局，如果不能查明或聯(lián)系上發(fā)射當(dāng)局，立即動(dòng)用一切可用的通訊手段告知公眾；其次，向聯(lián)合國(guó)秘書長(zhǎng)通報(bào)，聯(lián)合國(guó)秘書長(zhǎng)再動(dòng)用一切可用的通訊手段告知公眾（Notify the launching authority or, if it cannot identify and immediately communicate with the launching authority, immediately make a public announcement by all appropriate means of communication at its disposal; Notify the Secretary-General of the United Nations, who should disseminate the information without delay by all appropriate means of communication at his disposal）。

第二條提出：

如果有航天員因各種意外原因在某締約國(guó)管轄領(lǐng)域內(nèi)降落，該締約國(guó)應(yīng)立即采取一切可能措施營(yíng)救此人，并提供一切必要協(xié)助，該締約國(guó)應(yīng)將所采步驟及其進(jìn)展情形通知發(fā)射當(dāng)局及聯(lián)合國(guó)秘書長(zhǎng)（If, owing to accident, distress, emergency or unintended landing, the personnel of a spacecraft land in territory under the jurisdiction of a contracting party, it shall immediately take all possible steps to rescue them and render them al necessary assistance. It shall inform the launching authority and also the Secretary-General of the United Nations of the steps it is taking and of their progress）。

第三條則補(bǔ)充了航天員降落于公海上或不屬任何國(guó)家管轄之地點(diǎn)的情形，并要求具備援助能力的締約國(guó)對(duì)搜救行動(dòng)提供支持，同時(shí)將搜救進(jìn)展通知發(fā)射當(dāng)局及聯(lián)合國(guó)秘書長(zhǎng)（If information is received or it is discovered that the personnel of a spacecraft have alighted on the high seas or in any other place not under the jurisdiction of any state, those contracting parties which are in a position to do so shall, if necessary, extend assistance in search and rescue operations for such personnel to assure their speedy rescue. They shall inform the launching authority and the Secretary-General of the United Nations of the steps they are taking and of their progress）。

綜上，相關(guān)國(guó)際法只要求締約國(guó)盡力搜救那些已經(jīng)墜落至地表的，尤其是本國(guó)領(lǐng)土范圍內(nèi)的航天員，并隨時(shí)向國(guó)際社會(huì)通報(bào)有關(guān)情況，哪怕對(duì)極少數(shù)具備載人航天能力的航天強(qiáng)國(guó)，也沒有要求其動(dòng)用人員和設(shè)備前往外層空間實(shí)施救援。更何況，相關(guān)國(guó)際法對(duì)航天員遭遇的“意外”和“危難”狀態(tài)缺乏明確的界定，留出了較多的自由裁量權(quán)，讓締約國(guó)可以按自己的想法和意志來評(píng)估航天員的處境。

按照現(xiàn)行國(guó)際法，除非墜落于中國(guó)境內(nèi)或者周邊的公海，否則，中國(guó)沒有任何義務(wù)發(fā)射航天器上去搭救這兩名美國(guó)航天員。而NASA商業(yè)載人項(xiàng)目經(jīng)理還非得強(qiáng)調(diào)兩名航天員目前“非常安全”，“沒有被困”，那么中方就更有理由認(rèn)為他們“感覺良好”了，和什么“意外”、“危難”的狀態(tài)扯不上關(guān)系。所以，就算波音真的放下身段求助中國(guó)，也只能吃個(gè)閉門羹。

總之，在波音飛船航天員被困這件事中，無論是從責(zé)任認(rèn)定、任務(wù)可行性還是法定義務(wù)的角度來看，中國(guó)都是一個(gè)純粹的局外人，完全沒有參與其中的必要。真正值得注意的是，都是私營(yíng)航天公司，同樣擁有相似的發(fā)展模式，波音和SpaceX的產(chǎn)品研發(fā)和運(yùn)營(yíng)水平早已拉開了巨大差距，其背后的影響因素和經(jīng)驗(yàn)教訓(xùn)恰恰值得我們深入思考。
